Car Accident Advice: Someone hit me and doesn't want to go thru insurance?

Someone recently hit my car while it was parked across the street from my house. I almost thought it was a hit and run till I found their business card on my windsheild. I called her and she said she'd rather not go through her insurance but pay me directly for the damage to my car. I have been in accidents where I was hit but usually the other person just gives me their insurance info and I call them and get my car fixed fast, no problems. So I was already a little hesitant about agreeing to this, but I figured as long as it gets fixed it should be alright. So I did like she said and got an estimate from a body shop, then called her with it. Right off she said, Oh thats really high,(almost a 1000) and I reminded her that the damage is pretty severe, she backed into my rear passenger door, now entirely dented and scratched up. I know the estimate is fair compared to other work I 've had in the past. So anyways, I thought she'd decide right there like she had told me before, if it was affordable for her she'd pay me if not she'll go through her insurance. So since she acted like that was so much money I asked well does that mean you want to just use your insurance? She still sounded unsure and said she needs to figure this out. So it's been another day since that, still waiting, she did call again and say she's running it by her insurance agent to see which way would be better for her, insurance or pay me off. So I am still waiting, it's only been a few days since the accident but I am getting anxious because I kind of wish she would just give me her insurance info and go through it, my car would probably be in the shop already and this would be taken care of. But instead I 'm waiting for her. She still has not given me her insurance info, I don't have her license plate # or even what her car looks like, just a business card. And its a big inconvenience because I know I will be without a car for a at least 2-3 days, and even if she pays me she sure didn't mention a rental car. So my question is am I being too nice by waiting for her to decide whats best for her... and even if she wants to pay me should I have gotten her insurance info, like is that my legal right. The accident happened on a roundabout I was already on, someone pulled out on me and I T-boned the side of their car. An 'independent' assessor has looked at my car and wrote a damage report which went to the other drivers insurance company (who I am personally claiming from as my insurance is 3rd party cover only). Their company have now wrote to me saying they are denying my claim because: They can't understand why the whole front of the car is damaged (erm..because I T-boned the other car!) They can't understand why the nearside wing is damaged (erm..because she kept driving for a few seconds, which tried to drag my car to one side. The chassis went out of line and it moved the wing out of position). They can't understand how the nearside door is damaged (erm..it isn't!). Is there much else I can do other than write to argue their statement? A solicitor or small-claims court would not be cost effective as I'm only claiming approx 400. What can I do?

I have an 11-yr old car with 106K miles that runs well. Last night I was rear-ended quite hard while waiting at a red light. Both the other driver and his insurance co immediately admitted liability. The damage to my car is pretty bad. I went to the auto body shop recommended by the other guy's insurance co - they told me the car will have to be totalled b/c it will cost more to repair than what the car is worth - he estimated the car is worth $2K and repairs will be at least $4K. So the insurance co is saying they'll give me a check for $2K and I have to get rid of the car (apparently that part is New York law). But I cannot buy another car - at least not one I'd trust to drive! - for $2K. The accident was completely NOT my fault - how can the insurance co not pay to repair it? Has this happened to anyone else out there? Is there anything I can do? I don't want to give up my car! :( Please help?

When I bought my car I started paying 1,400 a year on insurance, and the other day I got a letter through the post from my insurance company saying that I need to renew my car insurance since it was close expiring. I'm a 43-year-old very healthy woman who doesn't smoke. My children are on Oregon Health plan and my husband has several health problems and is on permanent disability and medicare. So..I don't qualify for Oregon health plan and we cannot afford most health insurance plans. So....I was thinking an HSA might be good for me since I have no health issues. To clarify, I am not interested in adding my children or husband to this. Just for myself...as they are already covered just fine. Wondering what the average cost per month is and wondering if it matters what credit score you have...because mine is very low currenty due to my husband's medical bills hurting our finances a few years back.
